How to obtain Spanish nationality? There are several ways to apply for Spanish nationality. Keep reading and we will explain everything to you.

We will talk about the cases in which expatriates and immigrants in general can apply to obtain nationality. It is by residence, understanding that this residence can be obtained in several ways (roots, marriage, work, non-profit).

What do I need to get it?

Now, being a resident is the first step to be eligible but it will depend of your nationality how many years you need to live in Spain, as this will directly affect the years you must spend as a resident to apply.

There is a general regime called indicated by the Law and, therefore, to be able to apply for nationality they must have a minimum residence of 10 years legally and continuously in Spain.

But how do I know if I am an exception?

1 year residence

As a Spanish spouse, you should only be legally residing for a period of 1 year from the granting of residence. Likewise, those born in Spain will enjoy the benefit of opting for residence only with the proof of having one year of legal residence.

2 years of residence

Natives of Latin America, Andorra, the Philippines, Equatorial Guinea, Portugal or of Sephardic origin must only reside in Spain for 2 years to be able to opt for nationality, understanding that the residence has not been interrupted.

3 years of residence

Lastly, people who are in refugee status in Spain can access nationality as long as they are in the territory for at least 5 years.

How do I know if I have been in a legal and continuous way?

Legal and continuous residence is considered to be one that has not been interrupted by changes or by prolonged stays outside of Spain.

That is, in cases where, for some reason, you have ceased to be in the country legally (although this situation is later recovered), the computed time will be lost and it will start again from the moment it is legal. However, in the case of prolonged stays, although it may not be subject to loss of residence, it may cause the option of nationality to be lost.

Presentation of nationality

If you are about to complete the years that your nationality and condition require to apply through this process, you must obtain the documentation that you need for this, which will be:

1. Complete and valid passport

2. Certificate of citizen of the European Union or valid foreigner identification card

3. Birth certificate with less than 3 months of issue (if it does not indicate its expiration) apostilled

4. Criminal record of your country of origin apostilled

5. Criminal record in Spain

6. Qualification suitable for the CCSE and DELE test (the latter for citizens who do not have Spanish as an official language in their country of origin)

7. Certificate of empadronamiento with less than 3 months of issued for the date on which the nationality will be presented.

All documents must be duly legalized or apostilled and translated into Spanish by an official translator.

Where I can request it?

The presentation must be made by digital registration. You can do it by yourself or through a representative, and it may be followed up through the electronic platform “¿Comó va lo mio?”
