Starting a new life in Spain entails many kinds of formalities, starting to establish social relations again and, in short, developing as a person in another part of the world. It is possible that, in the midst of all these formalities and social relations, the big moment will come: the wedding. But what are the main requirements for getting married in Spain?

Whether you’ve already come to Spain with your partner or you’ve found love here, getting married is usually very useful for the legal formalities that may come up later in life. In this new post we explain everything you need to know about it.

Firstly, it is important to know that, in Spain, there are two possible ways: civil marriage and church marriage.

Civil ceremony

Requirements according to the Civil Code:

  • The marriage application must always be made by two people.
  • The applicants may not be unemancipated minors.
  • Neither of the applicants may have any marital ties.
  • Applicants may not be direct relatives by adoption or consanguinity.
  • Applicants may not be collateral relatives up to the third degree.
  • None of the applicants can be convicted as perpetrator or accomplice of the violent death of the former spouse.

Necessary documentation:

To get married in Spain by civil marriage it is necessary to present the following documentation at the Civil Registry:

  • Photocopy of the DNI of both applicants.
  • Photocopy of the DNI of two witnesses, who will be necessary for the marriage to take place.
  • Birth certificate of both applicants.
  • Current census registration certificate of both applicants.
  • Affidavit of marital status of the spouses.

How does the process work?

The two applicants and their witnesses must appear jointly before the Civil Registry Office. After submitting all the necessary documentation, the legal process begins.

Once the documentation has been submitted, the date of the celebration must be reserved. Getting married at the Civil Registry Office is free of charge and the whole process usually takes between 30 and 50 days.

Church ceremony

Requirements:

  • You will have to go to the church of your choice and apply for marriage.
  • You will need to apply for the marriage file.
  • It is compulsory to take a pre-marriage course.
  • At the end of the course, the documents required for the civil marriage, the baptismal certificates and the certificate of the pre-marriage course must be submitted.
  • You must agree a date for the celebration of the marriage.

Two foreigners getting married in Spain

If you are both foreigners and want to celebrate the marriage according to Spanish law, you must present all the required documents translated and legalised by the corresponding embassy and the Ministry of Foreign Affairs.
