For those who were in Spain between the month of March and June, that name generates apprehension and, for those who have only heard what was experienced, it generates concern. However, the recent state of alarm, with an initial duration until November 9 has different characteristics than the previous one. On this post we will explain what you can or cannot do during it.

First of all, it must be explained that the state of alarm is nothing more than a measure that the executive arm of the State can take in cases of emergency in order to limit the constitutional rights of Spanish citizens and residents and, therefore, dictate regulations that help to restore normality.

Because emergencies of this level have not existed in the contemporary era in the public health area, there is no legislation that contemplates these specific situations. The closest legal figure they could find to limit certain aspects of life in this way was this measure.

What is the difference with the previous state of alarm?

The measures that the State has taken are different, in general more lax, that is, there is no confinement as such and, therefore, activities can be carried out normally as long as they do not conflict with the measures taken not only by the national government, but also by the autonomous government.

This is another characteristic to highlight of this state of alarm. The Autonomous Communities have the power to decide, being then they the ones that can dictate measures according to the situation in which they are in terms of health and also modify these of in accordance with the evolution of the pandemic in their territories.

This is how the Autonomous Communities can be completely closed, preventing the entry and exit of their inhabitants, both from their areas and from the entire community, depending again on the criteria that they establish for this.

What I can do?

As general measures, until November 9, there is a curfew between 00:00 and 06:00 hours so, regardless of the location, the population will not be able to be on the street during that time unless they have proof to. That is, for coming or going to work, to return to your home or for the assistance of a third person.

Likewise, social gatherings may not be of more than 6 people, both in public and in private, with the exception that they are cohabiting and will also be part of the sum of this number of people. That is, if there is a family of 4 people they could only meet 2 more pople in the same space.

The use of a mask in public and local spaces, as well as maintaining the safety distance as long as it is possible, continues to be part of the national regulations, with the possibility of being fined in case of not complying with these guidelines.

Now, as we pointed out previously, each Autonomous Community may dictate additional measures according to its criteria. Some examples of closed borders are Navarra, Asturias, or Aragón, but other communities can be also added to this list or, on the contrary, to consider that the situation improves, can be removed from this list.

How long will these measures last?

While the state of alarm lasts, the measures will be in force and may change, but without a certain date of termination. Likewise, there may be court decisions that consider the viability of either some measure or the entire state of alarm negative, so that the situation could change, being then essential being attentive to both, executive and judicial decisions.
