What is arraigo?

It is nothing more than a regulated procedure to obtain legal residence in Spain. Its main purpose is to regularize the situation of those nationals of non-European countries who are in the territory for more than 3 years and do not have a residence permit.

This is how the legislation devised a way to integrate this submerged population that for different situations is in the country. These people are able to be integrated into the labor market and, therefore, to keep the economy active.

And what do I need to get it?

In addition to fulfilling and being able to demonstrate the 3 years of residence in Spain with public documents such as the register, you must have a work contract in Spanish territory. This contract must comply with the provisions of the law, as well as being full-time.

Likewise, the company or person that carries it out must demonstrate sufficient financial solvency to be able to hire a person under the conditions described above.

But there is a 2-year arraigo. How does it work?

Yes, there is indeed the arraigo called laboral. It can be applied to this after two years of being in the country, as long as it is proven that you have been in a labor relationship for at least 6 months.

Said demonstration may only be through a judicial declaration or an administrative resolution issued by the Labor and Social Security Inspectorate.

What are the benefits of the arraigo?

Mainly regularize the stay in Spain and also obtain a work permit that will allow work activity throughout the territory. It will also benefit mobility through the European Union of transit and tourism without migratory problems, since without residence you cannot be in the Schengen space for more than 3 months.

On the other hand, you will obtain your NIE and later your TIE, and all the benefits that having this document entails. You will also can start to contribute to Social Security and make use of social services.

Once the arraigo is granted, the time to apply for Spanish nationality would begin to run. It depends on the country of origin of the arraigo.
